A Brooklyn Accident Attorney Addresses The Issue Of Bicycle And Vehicle Door Collisions

By Nelson Cozad

Bicycling is not only good exercise, it can be one of the most convenient and quickest ways to maneuver around in a busy city like New York. It can also be dangerous for riders who don't expect a car door to open suddenly. If you or your bike has been harmed in one of these incidents, you might need to call on a Brooklyn accident attorney.

There are various relatively common types of bike accidents. One such accident type often seen in the City settings is known as "doorings." This type of accident occurs when a driver or passenger in a parked car or truck, suddenly opens a door of a vehicle into the path of a cyclist.

Not everyone understands that it is actually against the law to leave a car door, on the traffic side, open any longer than it takes to get in or out of the car. It is also a violation to interfere with traffic or open the door at all until it is safe to do so.

These are New York state laws. New York City has an additional protective statute. It states that no one can get out of the traffic side of any vehicle in such a way that interferes with an approaching bicycle or car.

Local legislators enacted this law to protect people on bikes. They also wanted drivers to clearly understand the responsibility they have to be cautious. If you have experienced a collision with the door of a parked car, you might need to contact a good lawyer. You won't have much time to do it though because evidence can disappear along with cooperative witnesses.

In some cases this is not possible or just overlooked for one reason or the other. Counsel should still be consulted in order to evaluate your prospective case.
